The new Tobacco Bill is aimed at regulating the tobacco industry and seem to provide society with an array of both positive as well as negative aspects.
Looking at the Bill from a more optimistic point of view, it is evident that the Bill proposes to reduce the harmful effects of tobacco consumption and the use of electronic delivery systems(i.e. vape), by restricting the sale and marketing of tobacco products, particularly to the youth of our country. The Bill proposes a plain packaging provision which will drastically deteriorate the appealing nature these products have on the youth in particular. The increased tax on tobacco products may further encourage smokers to quit. Additionally, the Bill regulates the use of electronic cigarettes and vaping devices, which will assist in preventingthe youth from getting addicted to nicotine-based products, as this is currently a pressing issue in the younger generation.
On the opposing side however, the Bill may lead to overregulation, restriction of innovationand creation as well as limiting consumer choice. This will evidently have a negative impact on the tobacco industry and could lead to what may be described as a domino effect of consecutive job losses. The increased tax on tobacco-based products will also disproportionately affect low-income smokers, and the restrictions on electronic delivery systems and devices may limit their effectiveness as a smoking cessation tool and ultimatelykeep individuals on traditional tobacco-based products. Furthermore, the Bill may lead to a thriving black market for tobacco and vaping products, fuelling organized crime and tax evasion as evidently seen during the COVID-19 epidemic. Lastly, some provisions relating to the regulation on packaging may not have any effect on the long-term smoker.
In conclusion, although the Tobacco Bill has certain praiseworthy goals, its implementation must be cautiously considered with regards to the balance of public health concerns with individual freedoms and avoid unintended consequences. The success of the bill is heavily dependent on its ability to navigate the blatant complexities it brings forth and finding a harmonious balance that truly benefits society as a whole.
